We have accrued expertise over many years in the handling of complex and tricky dismissal cases, from dismissal for compelling reasons to the dismissal of protected employees. We will notify you of the potential risks associated with a manifestly unreasonable dismissal, about what to do in the event of long-term illness or unauthorised absences. We will seek negotiated solutions whenever possible in conflict situations.

Cygnus Advocaten will explain in fine detail the distinction between working with employees versus self-employed contractors, and the associated risk of bogus self-employment.

We also provide advice and assistance in the event of (imminent) collective social conflicts such as strikes and company occupations. We can assist with transfers, restructuring and collective redundancies. Cygnus Advocaten can offer assistance with social elections and represent your interests in any legal discussions arising from them.

We have also acquired specific expertise in social criminal law (non-Dimona reporting, deployment, welfare legislation infringements, serious industrial accidents, etc.). We are increasingly becoming aware that companies are facing social inspections, whether or not in response to a complaint or incident in the workplace. We will help you prepare for, and support you during, your cross-examination, liaise and negotiate with the Labour Auditor’s Office, defend you vis-a-vis the administrative penalty department, and defend you before the Correctional Court.

We also believe that it is important to convince our clients to adopt a preventive policy. Audits related to various social law obligations - including the main aspects of a preventive safety policy - are consequently particularly useful and our complementary team can guide you in this respect as well. If required, we can organize in-house training tailored to the requirements of your company.
